Burst filed a patent
suit against Apple in the year 2004 alleging infringement
of its patents relating to Digital Video Recorder (DVR)
technology. In response, Apple counter-claimed for patent
invalidity. The parties have now settled the patent
infringement suit through a settlement agreement. Under
the agreement, Burst agreed to drop its infringement suit
in return for a lumpsum payment of ten (10) million
dollars including court and attorney fee. Apple has also
agreed to take a non-exclusive license over the patents
held by Burst.
LG
Philips settles a patent dispute with Chunghwa Picture
Tubes
In the years 2002 and
2005, LG Philips LCD (LG Phillips) sued Chunghwa Picture
Tubes (Chunghwa) alleging violation of some of its LCD
related patents. The parties have now agreed to put an end
to their patent dispute through an out of court
settlement. Under the settlement, Chunghwa has agreed to
pay a certain undisclosed sum of money to LG Phillips in
return for withdrawing the suits. The parties have also
agreed to share the LCD related patents of each company
through a cross-license.
Application
for GI protection over Darjeeling
tea
The Tea Board has filed
an application to register 'Darjeeling
tea' as a Geographical Indication (GI) in
Europe. The Tea Board had already registered'
Darjeeling
tea' as a GI in India. The Board had also registered 'Darjeeling
tea' as a trademark in
USA, UK
and other countries before the advent of GI law. The recent
application of the Board fortifies its international
enforcement strategy against misuse of the 'mark'.
