Injunction against Palm denied

After settling a patent infringement suit with RIM for 612.5 million dollars, NTP has now filed a patent infringement suit against Palm. NTP alleged in its suit that Palm's line of Treo smart phones and software related to them violates its patents relating to wireless email systems. NTP filed for an injunction against Palm to stay sale of Palm's products. The court denied the injunction and permitted Palm to continue selling its products and services while the infringement suit is pending.

Standards and Patent Policy

The International Electrotechnical Commission (IEC), the International Organization for Standardization (ISO) and the International Telecommunication Union (ITU) have agreed upon a policy relating to patents in international standards. The policy requires companies to bring patents or patent applications relating to any standards that are being developed to the notice of the international organisations. It will ensure that patents do not impede the implementation of standards and that the patent holders are adequately protected and compensated. As per the policy, a company's patents may be included in the standards provided the company makes the patents available to others under reasonable and non-discriminatory terms and conditions.

Vonage held liable for patent infringement

Verizon filed a suit against Vonage alleging that Vonage's technology to connect phones from its Internet Protocol service to traditional phone networks and other activities violate patents held by Verizon. Vonage argued that it was not liable because it uses third party technology, which is a standard in the industry. The court held Vonage liable for patent infringement and granted damages of 58 million dollars in addition to 5.5 percent royalty over revenues for future infringements.

Blockbuster sued for patent infringement

Netflix has recently obtained two patents on business methods. One relates to the selection, delivery and return process and the other refers to the no-late-fees policy and the way in which clients can alter their movie lists. Netflix sued Blockbuster for patent infringement alleging that Blockbuster's online DVD rental service infringes the two business method patents held by Netflix.
