Injunction granted to Samsung  

The Delhi High Court granted the first of its kind exparte injunction to Samsung with regard to parallel importation of its ink cartridges and toners. The injunction restrains dealers from dealing with catridges and toners having the trademark of Samsung. The Court held that importation of goods that fail to meet the labelling requirements and that do not possess the guarantees and warranties of the manufacturer without appropriate authorization would amount to trademark infringement. Samsung hopes to control grey market imports through such aggressive legal action.

Microsoft and Epson cross-license

After entering into cross-licensing agreements with leading technology companies such as Cisco Systems, Nortel Networks, Siemens, SAP, Toshiba and so on, Microsoft has entered into a license deal with Epson, which has developed a strong portfolio of patents and is highly ranked in the number of patents it files every year. Microsoft and Epson entered into a cross licensing agreement to mutually access each other's Intellectual Property in consumer and business electronics sectors. Through the cross-license the companies plan to protect their Intellectual Property at a global level and take benefit of each other's strengths in the market place. The specific details of the license agreement have not been disclosed by the parties.

Patent for data, voice and video over a unified network

Cisco has been granted a patent over a method of providing integrated voice, video, and data content in an integrated service offering to one or more customer premises.

 

Its time to Bank on your IP

The era of mortgaging your tangible assets is counting the last few days of its existence. We are slowly moving to the era of mortgaging the intangibles i.e. mortgaging your Intellectual property. Bank of Communication, Beijing has come up with a first of its kind product where loans can be acquired by mortgaging ones Intellectual assests. Few days ago Beijing Kery Bio,  a pharm company got a 1.5 million yuan loan from the Bank by mortgaging one of its invention patents, valued at 6 million yuan. 

The scheme will be a boon to small and medium sized enterprises who find it difficult to get loans on their fixed assets. As per the bank norms, patents with a validity period of at least eight years, utility patents with a validity period of no less than four years, and profitable trademarks can be used as mortgage.  The bank is considering to expand this service to all its branch shortly.
